Obama's Harriett Miers, I mean Kagan

When the left appoints somebody who's never written on controversial issues, it's time to jettison the "unoffensive" approach to nominations. We will have a court of nobodies with no abilities at this rate.

She is boring, unimaginative and a Harriet Miers choice, but nobody will oppose. Geeze. We deserve what we get now. So Borking only goes one way. Republicans are gutless.

NYTimes headline says she is a scholar but not a judge.
Umm, how can you publish two of three articles in your entire career and be considered a scholar? |

Her articles are surveys of law, articulating no new principle or concepts, but rather just state the current status of the law. So that makes her a scholar, I suppose. Again, Harvard status conveys an aura of scholarship.

Lesson learned. If you're a liberal who attended Harvard, you are a leading scholar.
If you are conservative who attended a non-Ivy league school, and have published widely a guiding interpretive concept, you are a wild-eyed lunatic. http://en.wikipedia.org/wiki/Robert_Bork
